1. PROMOTION DESCRIPTION: WEBTOON Entertainment Inc. (“Sponsor”) would like to celebrate reaching 30,000 followers on the @webtooncanvas Twitter account and thank its loyal followers by offering an opportunity to win a Discord Nitro Classic 1-year pass. The WEBTOON CANVAS 30K Twitter Giveaway (the “Promotion”) begins on August 3, 2021, at 12:00 p.m. Pacific Standard Time (“PST”) and ends on August 8, 2021, at 11:59:59 p.m. PST (the “Promotion Period”). By participating in the Promotion, each promotion entrant (“Entrant”) unconditionally accepts and agrees to comply with and abide by these official rules (the “Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor will not verify receipt of entries. 

 

2. ELIGIBILITY: The Promotion is open to legal residents of the contiguous United States and the District of Columbia (excluding residents of Rhode Island and Maine) and Canada (excluding residents of the province of Québec), aged 13 years or older (as of the date of Entrant’s entry). The Promotion is otherwise void where prohibited or restricted by applicable law. All eligible Entrants under the age of 18 must have parental consent in order to be eligible for the Promotion and to claim any prize (See General Prize Conditions for more details). Employees of Sponsor, its parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertisers, advertising and promotion agencies and affiliated entities, and their respective immediate family members or members of the same household (whether or not related) (collectively, the "Promotion Entities") are not eligible to participate in the Promotion. The Promotion is governed by California and U.S. Federal law and subject to all applicable federal, state and local laws and regulations. You must have an active, personal Twitter account to enter. Go to either twitter.com for instructions on how to sign up for a free account. By entering the Promotion, Entrants agree to accept and be bound by all terms of these Official Rules and Regulations.

 

3. HOW TO ENTER: There are two (2) ways to enter the Promotion (each, an “Entry”). (1) Twitter Entry: Sign in to your Twitter account and navigate to the official WEBTOON page on Twitter (@WEBTOONCANVAS). Sponsor will post a WEBTOON CANVAS 30K Twitter Giveaway posting (the “Twitter Promotion Post”) on the @WEBTOONCANVAS Twitter page. To enter, you must first 'Follow' the @WEBTOONCANVAS Twitter account using your personal Twitter account. Next, comment on the Twitter Promotion Post and comment what your favorite WEBTOON CANVAS series title is and why; OR (2) Mail-In Entry: Legibly print your full name, postal address, valid email address, phone number, and date of birth on a piece of paper or a 3”x5” index card, write down your favorite WEBTOON CANVAS series title, and mail it to Sponsor’s address below. To be eligible, mail-in entries must be postmarked by August 8, 2021 and received by Sponsor no later than August 13, 2021. Each Entrant shall be permitted to submit only one (1) comment on the Twitter Promotion Post throughout the Promotion Period. Limit one (1) Entry per person or per household. 

 

Incomplete, illegible, false or deceptive entries are void. All entries must be received by 11:59:59 p.m. (PST) on August 8, 2021. Sponsor’s computer shall serve as the official time keeping device for this Promotion. Sponsor will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will neither be acknowledged nor returned. Regardless of method of entry, if you choose to enter via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities. This Promotion is in no way sponsored, endorsed, or administered by, or associated with, Twitter® or Discord®. You are providing your information to Sponsor and not to Twitter or Discord.

 

4. WINNER SELECTION AND NOTIFICATION: On or around August 16, 2021, ten (10) winners (each, a “Winner”) will be randomly selected from all eligible Entries received throughout the Promotion Period. The odds of winning will depend on the total number of eligible entries received. Promotion drawings will be administered Sponsor and the decisions of Sponsor, in all matters regarding the Promotion, are final and binding. Promotion Entities will make two (2) attempts to notify each potential Winner using either Twitter Direct Message, as appropriate given the source of the selected entry. The Potential Winner must respond and provide their full legal name, email address, and Discord username within two (2) business days of the initial notification, or an alternate potential Winner may be selected from the remaining eligible entries. Noncompliance within this time period may result in disqualification, and, at Sponsor’s sole discretion an alternate potential Winner may be selected from the remaining eligible entries. If a potential Winner cannot be reached, does not comply with Sponsor’s confirmation instructions before Sponsor’s confirmation deadline, is found to be ineligible, cannot or does not comply with these Official Rules, or if the prize or winner notification is returned as undeliverable, the potential Winner will be disqualified, and an alternate Winner may be selected from the remaining eligible entries at Sponsor’s sole discretion. Limit one (1) Prize (defined below) per person or per household.

 

5. PRIZES: Ten (10) Prizes are available: Each Prize consists of one (1) Discord Nitro Classic 1-year pass (each, a “Prize”). The Approximate Retail Value ("ARV") of each Prize is Forty-Nine United States Dollars and Ninety-Nine cents (US$49.99). Sponsor will not replace any lost, mutilated, or stolen Prizes. No cash alternative or Prize substitutions will be allowed, except Sponsor reserves the right to substitute Prize(s) of comparable value if the Prize listed is unavailable for any reason. Any stated difference between the approximate value and actual value of the Prize or any substituted prize will not be awarded. Odds of winning depend on the number of eligible entries received. The total ARV of all Prizes to be awarded is Four Hundred Ninety-Nine United States Dollars and Ninety cents (US$499.90).

 

6. GENERAL PRIZE CONDITIONS: Each Prize Winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize. Each potential Winner will be required to execute an Affidavit of Eligibility and Release, and if applicable, a Parental Consent Form, by email (collectively, “Prize Claim Documents”). If a potential Winner fails or refuses to acknowledge and return all Prize Claim Documents in accordance with these Official Rules or any provided instructions, the potential Winner may be disqualified and an alternate Winner may be selected.

 

7. PUBLICITY GRANT: An Entrant’s participation in the Promotion constitutes permission for Sponsor, and its designees, to use such Entrant’s Entry, as well as Entrant’s legal name, social media handle, or other form of ID, and likeness, for advertising and promotional purposes (including paid media), in any manner, in any and all media now or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission, except where prohibited by law and as otherwise provided herein. 

 

8. PRIVACY POLICY AND DATA COLLECTION: In accordance with the Official Rules, children under thirteen (13) years old are not allowed to participate in this Promotion. If Promotion Entities find that a child under thirteen (13) years old has participated and/or has been selected as a potential Winner, Promotion Entities shall immediately cancel such selection and delete the associated personal Information. You hereby agree that Promotion Entities will collect your full legal name, email address, and Discord username, which will be used only for the delivery of the Prize and for no other purpose. By providing personal information, you hereby agree to the collection and handling of your personal information by Promotion Entities in accordance with Sponsor’s privacy policy, located at https://www.webtoons.com/es/terms.

 

9. RELEASE; LIMITATIONS ON LIABILITY: By entering this Promotion, you (and your legal guardian, if applicable) hereby release and hold harmless each of the Promotion Entities, Twitter, Discord, and any organization responsible for sponsoring, fulfilling, administering, advertising, or promotion this Promotion, their respective parents, subsidiaries, and affiliates, and each of their respective officers, directors, members, employees, agent, and subcontractors (collectively, the “Released Parties”) from any and all claims, injuries, losses, or damages of any kind, including without limitation, death and bodily injury, resulting from or in connection, in whole or in part: (i) the use of the Entry, including without limitation any claim arising out of or in connection with copyright, trademark, rights of privacy, publicity, moral rights, other intellectual property rights, or false endorsement, (ii) the awarding, delivery, acceptance, use, misuse, possession, mishandling, loss or misdirection of the Prize, (iii) participation in the Promotion or any Promotion-related activity, (iv) any interaction with, or downloading of, computer information, or (v) a breach of your representations and warranties made herein. Released Parties are not responsible for illegible, lost, late, damaged, destroyed, inaccurate, delayed, incomplete, postage due, unintelligible, non-delivered, misdirected, stolen entries; or for incomplete, inaccurate, lost, interrupted or unavailable network, satellite, telephone networks or lines, cellular towers or equipment (including handsets), computer on-line systems, computer equipment, software, viruses or bugs, servers or providers, or other connections, availability or accessibility; or for unauthorized access to, or alteration of entries; or miscommunications, failed computer, telephone, cellular, satellite, or cable transmissions, lines or other technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, technical, mechanical, electronic or network, including, without limitation, any errors which may occur in connection with the administration of the Promotion or in any Promotion-related materials; or for the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Promotion or account used (e.g., creation of multiple Twitter accounts by one individual to leave multiple comments), as solely determined by the Sponsor, will be disqualified (and all associated entries will be void), and Sponsor reserves the right to terminate such Entrant’s eligibility to participate in this or any other Promotion offered by Sponsor. Released Parties are not responsible for injury or damage to Entrants’ or to any other person’s computer, electronic device or mobile device related to or resulting from participating in this Promotion. Without limiting the release provided above, and for greater certainty, Released Parties will not be liable for (a) any incomplete or inaccurate information, whether caused by wireless device users or by any equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized access to, or alteration of, entries; (c) any problems with or technical malfunctions of telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any website or combination thereof; or (e) damage to a Entrant’s or other person’s system or equipment occasioned by participation in this Promotion.

 

10. REPRESENTATIONS AND WARRANTIES: You (or your legal guardian, if applicable) agree, represent and warrant that: (a) you will be bound by these Official Rules and the Sponsor’s decisions, which shall be final in all respects; (b) the Entry will not be acknowledged or returned; (c) Winner’s acceptance of a Prize constitutes the grant to Sponsor and assignment of an unconditional right to use Winner's username, social media handles, name (first name and last initial only), voice, likeness, photograph, biographical and Prize information, statements about the Promotion and/or live and taped performances of interviews for any programming, publicity, advertising and Promotion purposes without additional compensation, except where prohibited by law; (d) the Released Parties are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software and for typographical or other errors in the offer or administration of this Promotion, including but not limited to: human errors, errors in the advertising, these Official Rules, selection and announcement of the Winner and distribution of the Prize; (e) the Released Parties are not responsible for any inability of the Winner to accept or use the Prize (or any portion thereof) for any reason; (f) Sponsor has the right to modify Prize award procedures at its sole discretion; (g) the Released Parties are not responsible for changes to functions that may interfere with the Promotion or your ability to timely enter; and (h) Released Parties are not responsible for any failure of delivery of potential Winner notification. Sponsor does not make any representation, warranty, or guarantee, express or implied, relating to the Promotion or the Prize.

 

11. PROMOTION INTEGRITY: If, for any reason, the Promotion or any part thereof is not capable of running as planned, or if the Promotion, or any website or application used in relation with the Promotion, becomes corrupted, hacked, abused, tampered with, or otherwise does not allow for the secure, proper and fair functioning and administration of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any implicated individual (and all associated Entries will be void) and/or to cancel, terminate, modify, or suspend this Promotion or any portion thereof. In the event the Promotion is cancelled, Sponsor shall work in good faith to award the Prize among all eligible, non-suspect Entries received prior to the time of such necessary cancellation.

 

12. DISPUTES; GOVERNING LAW: Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any Prize awarded, other than those concerning the administration of the Promotion or the determination of Winner, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Promotion, shall be governed by and interpreted under the laws of the State of California, U.S.A, without giving effect to any choice of law or conflict of law rules. By participating in this Promotion, each Entrant agrees that any and all disputes arising out of or relating in any way to this Promotion shall be litigated only in courts situated in Los Angeles, California, U.S.A.
